Bypass Trust

A trust used for tax planning purposes within a tax planned estate planning document. It is generally funded after the first death under the terms of a will or trust.  The surviving spouse is the beneficiary of the trust and the assets included within the trust will not be taxed upon the death of the surviving spouse. It is used to shelter the amount that can pass estate tax-free at death.
